A registered trademark gives you the exclusive legal right to use your brand name or logo for the goods and services it is registered for, lets you use the ® symbol, stops copycats, and is essential for marketplace brand registries, franchising and export. Rights run from the filing date, so an early application matters.
Our trademark desk runs a search of the Indian register for identical and similar marks, recommends the classes under the NICE classification (there are 45 — goods 1–34, services 35–45), prepares the application (Form TM-A) with the correct applicant category, e-files it, and handles the examination report reply, publication in the Trade Marks Journal and any opposition or hearing until the registration certificate is issued.
A registered trademark is valid for 10 years from the filing date and can be renewed indefinitely for further 10-year periods (renewal can be filed up to one year before expiry). We track the renewal date for every mark we file and handle renewals at the same professional fee plus the government renewal fee at actuals.
Application number on the day of filing; examination typically within a few months; registration in roughly 6–18 months if no objection or opposition is raised (timelines are set by the Registry).
™ may be used on any mark you claim as your brand, including one that is applied for but not yet registered. ® may be used only after the registration certificate is issued; using it earlier is an offence.
Trademarks are registered per class of goods or services (45 classes). A packaged-food brand is usually class 29 / 30, garments class 25, software class 9 / 42, restaurants class 43. Each additional class carries an additional government fee; we recommend the minimum set that actually protects your business.
Individuals, DPIIT-recognised startups and small enterprises holding a Udyam certificate pay the reduced fee per class; companies, LLPs and other entities pay the standard fee. The fee is as per the Trade Marks Rules (First Schedule) and is paid to the Registry at actuals.
An examination report is common. We draft the reply with the legal grounds and evidence and attend the hearing if one is fixed. Replies and hearings are covered under our service for that application.
A single application can cover a logo containing the name (a composite / device mark). For the widest protection we usually recommend a word mark plus a logo mark, filed as two applications.
